Mazhilis of the Parliament is considering amendments to legislation concerning the list of misconduct that discredits public service. The changes affect the behaviour of civil servants outside working hours if it undermines the authority of the government.
WHAT MISCONDUCT IS PROPOSED TO BE CLASSED AS DISCREDITING
According to the amendments, such violations are proposed to include the non-medical use of narcotic and psychotropic substances. The list also includes driving a vehicle while under the influence of alcohol, drugs, or toxic substances.
To identify and prevent the illegal use of substances, requirements for medical examinations are provided. Additionally, the document stipulates restrictions on civil servants' participation in gambling.
RECALL FROM STUDY LEAVE
The draft law provides for the possibility of recalling civil servants from study leave without their consent. This applies to cases of committing a disciplinary offence or violating standards of official ethics.
The measure is planned to be used for the prompt consideration of the issue of holding them accountable. Previously, the employee's own consent was required for recall from leave.
RESTRICTIONS ON SOCIAL BENEFITS
The amendments also affect benefits for temporary incapacity for work. The state plans to exclude payments for temporary incapacity for work if the injury or illness resulted from alcohol or drug use.
A similar ban on payments will apply in cases where a civil servant has committed a criminal offence. In this way, departments intend to strengthen disciplinary control.
