The court helped a pensioner recover money for a non-existent plot of land in the Zhambyl region

A pensioner from Zhambyl Region took a case to court after paying 2.5 million tenge for a plot of land that did not actually exist. The proceedings ended with a mediation agreement: the defendant agreed to return the remaining amount of debt.

HOW THE DISPUTE OVER THE PLOT AROSE

As established by the Baizak District Court of Zhambyl Region, the plaintiff entered into an agreement with the defendant to purchase a land plot worth 2.5 million tenge. The pensioner handed over the specified amount to the seller.

However, the transaction ultimately did not go ahead. During the proceedings, it emerged that the defendant did not have, and never had, the land plot that he had offered for sale.

After this, the defendant wrote a promissory note and undertook to return the money received.

WHY THE PENSIONER TOOK THE CASE TO COURT

According to the court, the seller only returned 500,000 tenge of the total amount. The remaining funds were not paid to the pensioner, so he filed a lawsuit to recover the debt.

HOW THE PROCEEDINGS CONCLUDED

During the examination of the case, the court applied conciliation procedures. As a result, the parties agreed to settle the dispute through mediation.

According to the terms of the agreement:

  • the defendant undertook to pay 2 million tenge of the debt;
  • the amount will be returned in three instalments;
  • the plaintiff withdrew the claim.

The court approved the mediation agreement, after which the proceedings in the case were terminated, and the state duty was refunded to the plaintiff.

The court ruling has already entered into legal force.
