The court has sentenced the driver for a fatal hit-and-run on a woman in Kokshetau.

A resident of Kokshetau has been found guilty of a fatal collision with a pedestrian in the yard of a residential building. The court sentenced her to 2 years and 6 months imprisonment, but the execution of the sentence was suspended for 3 years due to her having two young children dependent on her.

CIRCUMSTANCES OF THE CASE

The criminal case was heard in the Kokshetau City Court against citizen S., accused under Part 3 of Article 345 of the Criminal Code of the Republic of Kazakhstan ("Violation of traffic rules resulting in the death of a person through negligence").

The court established that in May 2026, the woman was driving a car without a driver's licence or the special right to operate vehicles. While turning into a house yard, she struck a pedestrian, Sh., causing serious bodily harm. The victim later died in hospital.

WHAT THE DEFENDANT EXPLAINED

During the court proceedings, citizen S. stated that she got behind the wheel because her husband's health had deteriorated. She said she was driving the car with his permission.

The criminal case concerning the vehicle owner allowing a person without a driving licence to drive was separated into a separate proceeding.

WHAT EVIDENCE THE COURT EXAMINED

During the trial, the defendant's guilt was fully proven. The woman accepted responsibility for the incident, showed remorse, compensated for the damage caused, and apologised to the victim's relatives.

Witness testimony, materials from the scene inspection, a diagram of the road traffic accident, expert conclusions, and video footage were also examined. According to Part 2 of Article 11 of the Criminal Code of the Republic of Kazakhstan, the offence committed falls into the category of minor gravity.

The victim's side stated that they had no material or moral claims against the defendant and asked that she not be imprisoned.

WHAT SENTENCE THE COURT IMPOSED

When imposing the sentence, the court took into account the convicted woman's sincere remorse, the presence of young children, voluntary compensation for moral harm, and her lack of previous administrative or criminal offences.

The court sentenced citizen S. to 2 years and 6 months imprisonment.

Under Part 1 of Article 74 of the Criminal Code of the Republic of Kazakhstan, which provides for a deferral of sentence for women with young children, the execution of the sentence was deferred for 3 years.

The verdict has not yet entered into legal force.
