The court found the driver of the former deputy head of the Almaty Road Police guilty of inaction in the Al-Farabi road accident case

Almaty's Medeu District Court No. 2 sentenced the driver of the former deputy head of the Almaty City Police Department (PD) to 3 years and 6 months' imprisonment. He was found guilty of dereliction of duty that led to grave consequences, within the case concerning a fatal road traffic accident on Al-Farabi Avenue.

WHAT SENTENCE THE COURT IMPOSED

According to Channel Seven, on 28 September the court found the defendant guilty under paragraph 1 of part 4 of article 370 of the Criminal Code of the Republic of Kazakhstan ("Dereliction of duty that led to grave consequences").

He was sentenced to 3 years and 6 months' imprisonment, to be served in a minimum-security penal correctional institution. In addition, the court permanently banned him from holding public service posts and stripped him of the rank of police sergeant.

The court also credited the time spent in custody from 26 March 2026 on the basis of one day for two days of imprisonment.

WHY THE COURT FOUND THE DEFENDANT GUILTY

Explaining the verdict, Judge Zhasulan Khusainov stated that the court considered the defendant's guilt proven to the extent of the charge brought, Informburo.kz reports.

In justifying the decision, he cited part 1 of article 19 of the Law "On Internal Affairs Bodies", which obliges police officers to take measures upon directly discovering an offence, regardless of their post or the time it was committed.

According to the prosecution's account, the defendant knew that the driver of another car had consumed alcohol, but did not prevent him from driving. Later he saw dangerous driving, but did not demand that he stop and did not call a police patrol.

The prosecution linked this dereliction of duty to the road traffic accident in which three people died. The court prohibited the disclosure of the convicted man's personal details at the request of the defence.

CONTEXT

The road traffic accident occurred in the early hours of 21 March on Al-Farabi Avenue in Almaty. According to the investigation, the driver of a Zeekr car, while in a state of alcoholic intoxication, was travelling at a speed of about 219 km/h, drove into the oncoming lane and collided with a Mercedes car.

As a result of the crash, three people died — the driver of the Mercedes and two female passengers.

After the road traffic accident, the Ministry of Internal Affairs (MIA) dismissed a number of senior officials from their posts. Criminal cases were also opened and an internal investigation was launched.

The crash caused a public outcry and once again raised the issue of the continuing road safety risks in Almaty, despite a decline in overall road traffic fatalities.

In June 2026, the Specialised Inter-District Criminal Court of Almaty completed its consideration of the case concerning the road traffic accident on Al-Farabi Avenue, as a result of which three people died. Aleksandr Pak was found guilty and sentenced to 10 years' imprisonment.
