Two joint-stock companies (JSCs) have settled a property dispute totalling over 5.5 billion tenge in the Aktobe region. The parties entered into a mediation agreement, under which the debt must be repaid by October 2026 in accordance with an agreed schedule.
HOW THE DEBT AROSE
According to the press service of the courts of the Aktobe region, one JSC supplied natural gas to another between January and May 2026 to the value of over 5 billion tenge. Payment for the gas supplied was not received, after which the supplier applied to court seeking recovery of the debt.
At the stage of preparing the case for trial, the Specialised Inter-District Economic Court of the Aktobe region explained the benefits of conciliation procedures to the parties and facilitated mediation. As a result, the defendant acknowledged the existence of the debt.
HOW THE PARTIES RESOLVED THE DISPUTE
Under the mediation agreement approved by the court, the debtor undertook to pay more than 5.5 billion tenge by October 2026. The parties agreed on a payment schedule and the procedure for fulfilling their obligations.
In addition, they set out the procedure for paying for current natural gas consumption and agreed to carry out monthly reconciliations of mutual settlements. The agreement also set out a mechanism for enforcing the obligations undertaken.
WHEN THE DEBT MUST BE REPAID
After approving the mediation agreement, the court terminated the proceedings in the case. The claimant was refunded the state fee paid, amounting to 86.5 million tenge.
Thus, the parties resolved a multi-billion dispute through a conciliation procedure, setting out the deadlines for repaying the debt and the procedure for future settlements.
