Shareholders of the capital's residential complex Sirocco Club risk losing their property

In Astana, dozens of shareholders in the Sirocco Club residential complex are reporting an attempt to deprive them of their rights to already paid-for apartments. Despite full payment for the housing and having all supporting documents, people are not being accepted into the new housing cooperative, creating risks of their property being resold.

According to the Telegram channel «HALYQSTAN», the story began in 2023 when shareholders, including young families, signed contracts with the developer of the Sirocco Club residential complex and made full payment. Many have retained notarised receipts, certificates of no debt, and decisions regarding their admission to the former cooperative.

However, construction progressed slowly, and some shareholders created an alternative cooperative - the «Zhaqsılıq» Housing Cooperative. They filed complaints with the police against the developer and the general contractor. By court order, the shares and the property were transferred to the new cooperative.

According to dozens of citizens, from that moment mass refusals to join the housing cooperative began. The reasons given are formal: errors in documents, non-compliance with technical expert examinations, or affiliation with the old developer. Meanwhile, neither shareholders nor their representatives are allowed to inspect the process.

"We have notarised receipts, correspondence with estate agents, certificates and proof of full payment. But they are effectively erasing us from the list," say the shareholders.

Those affected fear that in their absence the apartments could be resold, despite the new cooperative having no rights to alienate these properties. Statements from the legal department of the investor who came into the project are particularly concerning.

"If you are not on the list of the 'Zhaqsılıq' Housing Cooperative, you are nobody. Even if you win in court, nothing is guaranteed for you," they stated there.

According to the shareholders, the membership of the «Zhaqsılıq» Housing Cooperative is limited to a narrow circle of people, among whom are some with arrears on their contributions. Nevertheless, it is they who determine the future fate of the complex, including the fate of apartments that were previously fully paid for by others.

"We are not defending the old developer. Let him face the consequences. But why should we suffer, ordinary people who simply paid for housing? Why does someone else get to decide whether we live in our apartments or not?" the shareholders ask.

They also claim that the court decision on the transfer of the property was made in a matter of minutes – without consideration of the arguments of the parties. All appeals to the prosecutor's office and other government bodies have so far yielded no results. Moreover, at one stage, people were advised to join the new cooperative, but then a moratorium on accepting new members was suddenly introduced – retrospectively.
