The rights of shareholders worth over 6 billion tenge were protected by the prosecutor's office of the Aktobe region.

The prosecutor's office of Aktobe region has protected the rights of equity holders who suffered from the illegal actions of developers. There are 12 problematic shared-equity construction projects in the region, where 797 people have been recognised as victims, and the total damage has exceeded 6.1 billion tenge.

According to the press service of the department, some developers raised funds from citizens without legal grounds. In particular, the heads of HBC "AlashOrda-1" and RC "Aviator Premium" fraudulently attracted more than 200 equity holders, collecting over 1.8 billion tenge.

Furthermore, the court found representatives of HBC "Safina.kz" and RC "StroyServiceRegion" guilty of fraud, having illegally collected more than 3.2 billion tenge from equity holders. By court verdict, they each received 10 years of imprisonment.

The prosecutor's office clarified that this year, the heads of seven construction companies have been brought to criminal liability for 11 shared-equity construction projects.

The prosecutor's office also filed civil lawsuits: a total of 8 claims in the interests of 413 equity holders seeking to invalidate purchase agreements and transfer ownership of property.

For 6 claims concerning the interests of 285 equity holders, the court has already upheld the demands. Another 3 facilities involving 128 equity holders are currently under judicial proceedings.

The department noted that monitoring of the illegal raising of funds in housing construction is carried out on an ongoing basis.
