The prosecutor's office of the Almaty region has identified fictitious decisions of local executive bodies, on the basis of which the designated purpose of land was changed and plots were allocated. Following claims from the supervisory authority, the court declared these decisions illegal, and part of the land was returned to state ownership.
WHERE THE VIOLATIONS WERE IDENTIFIED
According to the prosecutor's office, in the Karasai district, the designated purpose of 5 hectares of agricultural land was illegally changed. The basis for this was fictitious decisions by the akimat.
Subsequently, this area was divided into 83 separate land plots.
WHAT THE COURT DECIDED
Following a claim by the prosecutor's office, the Karasai District Court declared the fictitious decisions of the local executive bodies illegal and overturned them.
A similar case was found in the Ili district. The akim's decision to grant a land plot for individual housing construction was also deemed fictitious.
By court order, the plot was returned to state ownership.
CRIMINAL CASE INITIATED
In connection with these facts, under the coordination of the prosecutor's office, the police department has initiated a criminal case under Part 3 of Article 385 of the Criminal Code of the Republic of Kazakhstan ("Use of a knowingly forged document").
Investigative actions are currently underway. In accordance with Part 1 of Article 201 of the Criminal Procedure Code of the Republic of Kazakhstan, the data from the pre-trial investigation are not subject to disclosure.
