Landowners of Kazakhstan. Chapter 2: Kostanay (Part 2)

Continuing the analysis of the largest land users in Kostanay Region, it is worth noting that two more subsidiary companies of Olzha Agro LLP occupy a significant area of agricultural land in the region.

OLZHA TOBOLSKOYE LLP

Olzha Tobolskoye LLP (growing cereals and leguminous crops, including seed production), owning an area of around 30.3 thousand hectares, was registered in 2018. The first head of the company is Artyom Ivanov

The company has a low risk rating regarding tax obligations, as well as a property tax debt amounting to 166 thousand tenge. For 2023, the company paid 83.3 million tenge in taxes (in 2022 – 17.9 million tenge, in 2021 – 16.6 million tenge, in 2020 – 26.8 million tenge)

In 2023, Olzha Tobolskoye LLP received a fine of 518 thousand tenge for failure to comply with an order to carry out necessary plant quarantine measures in foci of quarantine object spread on fields in Arshalinsky Rural District and in the village of Glebovka

OLZHA ALTYN-INVEST LLP

Another land user, occupying more than 73 thousand hectares - Olzha Altyn-Invest LLP (growing cereals and leguminous crops, including seed production), was registered in 2018. The first head of the company is Yermek Nugumanov, who is also a participant in Olzha Boskol-Astyk LLP. 

Olzha Altyn-Invest LLP has a low risk rating regarding tax obligations. For 2023, the company paid 253.3 million tenge in taxes (in 2022 – 386.5 million tenge, in 2021 – 367.4 million tenge, in 2020 – 182.9 million tenge).

Olzha Altyn-Invest LLP was involved in litigation for several years with the State Institution "Department of Housing and Communal Services, Passenger Transport and Highways of Fedorov District". Initially, a public procurement contract was concluded between the parties, according to which the LLP undertook to carry out road maintenance work in January-February 2021 for a total of 2.6 million tenge in the village of Kamysty, Fedorov District, Kostanay Region. 

At the time of drawing up the contract, Olzha Altyn-Invest LLP incorrectly indicated the bank account details, which led to difficulties with payment under the contract. As representatives of the company claimed, they subsequently sent the customer the current bank account details, but the LLP never received payment after signing the certificates of work completed, and was therefore forced to go to court. 

In court, representatives of the state institution insisted that payment for completed work is transferred no later than 30 calendar days from the date of signing the certificates of work completed. Due to the incorrect indication of the details, the state body could not make payment within the period established by the contract, and they did not receive the correct details. The term of the contract expired, on the basis of which the State Institution stated that the obligations of the parties under the contract had been terminated. 

The court did not accept the arguments of the state institution and obliged the Department of Housing and Utilities and Highways of Fedorov District to make full payment to Olzha Altyn-Invest LLP under the contract. In the summer of 2023, Olzha Altyn-Invest LLP was forced to go back to court with a claim against the State Institution "Department of Housing and Communal Services, Passenger Transport and Highways of Fedorov District" for recognition of the certificate of work completed and recovery of payment under another contract amounting to around 12 million tenge. The court granted the LLP's claim. 

In the summer of 2023, residents of the village of Bannovka, Fedorov District, Kostanay Region complained to regional journalists about the management of Olzha Altyn-Invest LLP, stating that the enterprise's base is located near their homes, and the poisons used at the enterprise are poisoning all living things. It was reported that garden plants in the village were dying, and the villagers themselves and their children were falling ill more often. They also claimed that they had repeatedly observed chemical smog over the settlement. 

Later, in September, the village was visited by a representative of Olzha Altyn-Invest LLP, Alexey Baynazarov, an employee of the Department of Ecology, Ziyada Bisakhalova, and the Akim of Bannovsky Rural District, Kira Velieva. During the inspection, it was revealed that the mixing unit was indeed located close to residential buildings, which contradicts the norm. 

However, representatives of Olzha Agro LLP informed the editorial board of the FBRC that the equipment and substances used at the enterprise are quite safe, and that the excessive concern of the media and local residents regarding the environmental situation in the settlement is due to completely different reasons.

KARABATYR AGRICULTURAL FIRM LLP

Karabatyr Agricultural Firm LLP (growing cereals and leguminous crops, including seed production) was registered in 1994. The first head and founder of the company is entrepreneur Marat Kudaikulov

The company has a low risk rating regarding tax obligations. For 2023, the agricultural firm paid 78.6 million tenge in taxes (in 2022 – 50.9 million tenge, in 2021 – 76.6 million tenge, in 2020 – 44.2 million tenge)

In 2017, Karabatyr Agricultural Firm LLP decided to undertake the reconstruction of the House of Culture building in the village of Karabatyr, Kamysty District, which was originally built without the necessary permits. Consequently, it was necessary to apply to the court to obtain the appropriate permission for the reconstruction. 

In 2018, the court granted the LLP's claim regarding the unauthorised construction, and thus the House of Culture building in the village of Karabatyr was recognised as the property of Karabatyr Agricultural Firm LLP. 

DARIA PEASANT FARM

Daria Peasant Farm (raising other cattle and buffalo) belongs to one Serik Tulekbayev. The Peasant Farm has a medium risk rating regarding tax obligations, as well as a tax debt for the use of land plots amounting to 96 thousand tenge. 

TIMOFEYEVKA AGRO LLP

Timofeyevka Agro LLP (growing cereals and leguminous crops, including seed production) has been registered since 2001. The first head is Sharkhan Kurbanov, and the founder is Sharbat Boranbayeva

Kurbanov also appears in companies such as Sana-Agro LLP, Altyn Astyk – 2030 LLP and the Kostanay Kokpar Federation Public Association. In 2022, Sharkhan Kurbanov was arrested for 15 days and banned from driving a vehicle for seven years for driving while intoxicated. 

Timofeyevka Agro LLP has a medium risk rating regarding tax obligations. For 2023, the company paid 99.8 million tenge in taxes (in 2022 – 36.9 million tenge, in 2021 – 17.5 million tenge, in 2020 – 22.1 million tenge)

To remind you, the editorial board of the FBRC is analysing the dynamics of the largest land users in Kazakhstan in order to ascertain how much agricultural land has been seized from them recently. 

Having familiarised ourselves with the territories of the Pavlodar and Kostanay regions, it is clear that there have been, as such, no global changes in the areas held by the latifundists.
