The Majilis has approved in the first reading the draft Law “On Artificial Intelligence” together with accompanying amendments to certain legislative acts.
According to Bluescreen.kz, this is the first systemic document in the history of Kazakhstan regulating the development and use of artificial intelligence (AI).
Thus, within the framework of the draft law:
- The legal and organisational foundations for the use of AI are defined;
- Requirements are established for developers, users, and owners of AI systems;
- A classification of AI by risk level is introduced — from minimal to high;
- Fully autonomous AI systems are prohibited within the country‘s territory;
- The use of AI without the user’s informed consent is prohibited, including manipulation and exploitation (age, disability, social status).
At the same time, the draft law provides for the creation of the National Artificial Intelligence Platform. It is expected to become an instrumental environment and provide access to data libraries for training. Integration with government and corporate systems is also planned.
The state also intends to support the development of the AI industry through:
- funding for research, technical, and development work (R&D);
- educational programmes;
- international cooperation;
- the development of local AI solutions.
Furthermore, the draft law prohibits:
- the use of AI without a person’s consent when influencing their behaviour;
- the use of AI that exploits vulnerabilities — age, disability, social status;
- social scoring — the assessment of people based on behaviour or characteristics;
- the analysis of people’s emotions without their consent;
- the creation and distribution of AI-generated content if it violates the law;
- the operation of fully autonomous AI systems.
At the same time, liability for damage caused by AI will lie with the owner or operator of the system.
“The possibility of voluntary insurance for such risks is being introduced, which in the future could become an additional form of protection for citizens’ rights”, the statement reads.
The second reading of the draft is expected after further amendments and discussions.
