Anti-corruption commented on the investigation into businessman Beibit Temirgali

An official representative of Anticor, Arman Tleukenov, gave a comment to the founder of the FBRK, Kirill Pavlov, regarding the criminal case on embezzlement against businessman Beibit Temirgali and his computer equipment manufacturing company, LLP «BSB Trade&Advertising»

Earlier, Anticor of the Zhambyl Region investigated a criminal case against the former head of the education department of the Baizak district, Nuraliyev N., on suspicion of abuse of official power, and the director of LLP «BSB Trade&Advertising», Temirgali B., on charges of embezzling budget funds. 

The Department of Internal State Audit of the Zhambyl Region established that in April 2020, the education department entered into a public procurement contract with LLP «BSB Trade&Advertising» for the purchase of 100 computers for the sum of 26.7 million tenge

The supplied computers did not comply with the technical specifications. Temirgali claimed that he had manufactured the computers in Kazakhstan, but during the investigation, he admitted that he had bought them from a Chinese company

Furthermore, it emerged that the difference between the contract amount and the cost of the computers was 17 million tenge. The Specialised Inter-District Economic Court of the Zhambyl Region ruled to recover the entire contract amount from «BSB Trade&Advertising» in favour of the education department. Temirgali was recognised as a suspect in the criminal case on embezzlement. 

Later, Temirgali appealed to the Supreme Court. During the cassation hearing, an examination showed that the disputed computers had been tampered with by someone, and some components had been replaced. In this regard, the Supreme Court overturned the decision requiring the company to pay the contract amount to the state body. 

Meanwhile, information also appeared online that the court ruling allegedly stated that the replacement of parts was carried out not by the manufacturer, but by the plaintiff, i.e., someone from the akimat. Despite the Supreme Court's decision, Temirgali remains suspected of embezzling budget funds during public procurement. 

According to Anticor's data, the civil and criminal cases against Temirgali do not contradict each other, and the rumours circulating online that someone from the akimat tampered with the computers do not correspond to reality.

The department also noted that Temirgali had previously been held criminally liable for causing property damage during the supply of computer equipment to schools in Astana without the necessary software during the pandemic. The criminal case was later terminated based on a reconciliation between the parties.
