The Senate of the Parliament of the Republic of Kazakhstan has approved a law on the reorganisation of the judicial system.
"The Senate of the Parliament approved in two readings a law on reforming the judicial system and improving procedural legislation", the press service of the Supreme Court reported.
From 1 July 2025, full cassation in civil and criminal cases will be introduced. This means that citizens will submit a cassation appeal rather than a petition for review of judicial acts.
"Unified rules for cassation review for all types of legal proceedings are being introduced. By analogy with administrative cases, the time limits for considering criminal and civil cases in the cassation instance will be carried out within a reasonable time, but not exceeding 6 months", the statement said.
At the same time, from 1 July 2027, it is planned to remove restrictions on disputes related to property for individuals with a claim amount less than 2,000 MRP and legal entities with a claim amount less than 30,000 MRP. The same applies to criminal misdemeanours and crimes of minor gravity.
It is noted that judicial acts in administrative cases will come into force after they have been appealed.
Furthermore, from 1 March 2025, it is planned to introduce "extraterritorial jurisdiction in administrative cases at the choice of the plaintiff", where the defendant is an administrative body. This is expected to affect the efficiency of state bodies.
In addition, due to the creation of independent cassation courts, the role of the Supreme Court will also change.
"Its main purpose will be the study and consolidation of judicial practice and issues of compliance with the rule of law in the administration of justice", the statement said.
