The Shymkent court has passed a sentence in a criminal case involving the head of the financial management department of the police department (PD) Bakhtiyar Bayanov, his deputy Kuanysh Abdalin, department employee Kanat Kabylov, and the director of LLP "Satelit-A" Timur Kostin.
According to Vera.kz, businessman Kostin was initially charged with embezzlement of another's property on an especially large scale by a group of persons and bribery. Bayanov and Abdalin were accused of appropriating another's property on an especially large scale by a group of persons and receiving bribes on an especially large scale. Kabylov was charged with negligence that negligently caused grave consequences.
However, during the trial, the state prosecution revised the classification of the offences. The prosecutor asked the court to exclude the episodes of offering and receiving bribes from the charges for all except Kabylov. Subsequently, the article on embezzlement of property for Kostin and Bayanov was reclassified as fraud, and Abdalin's actions were reclassified as abuse of official authority.
According to court materials, the head of the department, Bayanov, proposed to businessman Kostin that he ensure his company's victory in a public procurement tender. He valued his "services" at 74 million tenge. After winning the tender and the transfer of funds to the company's account, Kostin handed over the agreed amount to Bayanov.
The court established that the deputy head of the department, Kuanysh Abdalin, signed a contract worth 370 million tenge using a "single-source" procurement method, which allowed LLP "Satelit-A" to avoid competition. It is reported that the third police officer, Kanat Kabylov, improperly accepted goods that did not meet the technical specifications stated in the contract.
As a result, the court found Bakhtiyar Bayanov guilty of fraud and sentenced him to 6 years and 8 months of imprisonment. His deputy, Kuanysh Abdalin, was sentenced to 2 years of imprisonment. Kanat Kabylov received 2 years of restriction of liberty. At the same time, the former police officers were permanently banned from holding positions in the civil service.
The director of the enterprise, Timur Kostin, was also found guilty and sentenced to 5 years of suspended imprisonment with a ban on holding management positions in commercial organisations for 5 years.
As it became known, LLP "Satelit-A" was registered 16 years ago. Timur Kostin has been the head of the company for the last 11 years. The company is engaged in wholesale trade of a wide range of products, including supplies in the field of information technology. Over the years of operation, the enterprise has paid 692 million tenge in taxes. However, the company has a debt for taxes and customs payments of about 6 million tenge.
The company "Satelit-A" is an active participant in public procurement. The total value of contracts amounts to 2.5 billion tenge. Among the largest clients in 2024 is the PD of the Turkestan region, with which a contract worth 72.8 million tenge was concluded for the maintenance of a video surveillance system.
In 2023, the company concluded 7 contracts worth 838 million tenge, including with the PD of the Atyrau region for the supply of 23 radars for recording traffic violations. In 2022, there were 11 contracts, the largest being with the PD of Shymkent for 195 million tenge. However, journalists were unable to find the contract that became the subject of the criminal case on the public procurement website.
Incidentally, Timur Kostin is also the founder of LLP "Darkom", registered 16 years ago. The company is engaged in wholesale trade but participates in public procurement only occasionally. The last transactions date back to 2016. The total amount of taxes paid is 42.2 million tenge.
