The family of the deceased rescuer Oleg Tyshkevich, who died at the Maikainzoloto mine, have had their compensation for moral damages reduced. Instead of the previously claimed 120 million tenge, his mother, sister, daughter and son will receive 30 million tenge.
According to Press.kz, the civil judicial panel of the Pavlodar Regional Court ruled to reduce the amount of moral damages to 7.5 million tenge in favour of each individual.
"In determining the amount of compensation for moral damage, the court of first instance was guided by the accident report related to work activity, as well as by the report of a special investigation into the circumstances of the accident, which established 100% employer fault. Meanwhile, the court did not take into account that the accident was related to the production activities of 'Maikainzoloto'. These circumstances must be considered by the court when determining the amount of compensation for moral damage.", the court added.
The ruling has entered into legal force.
It is noted that in September, the Ekibastuz city court granted the claim for 120 million tenge in favour of the relatives of mine rescuer Oleg Tyshkevich, who died on the territory of JSC 'Maikainzoloto'.
Recall that on 4 January, near the shaft of the Maikain mine, a bus carrying four mine rescuers fell into a 150-metre-deep pit in the goaf area. Information about the discovery of two bodies later emerged. The bodies of rescuer Aidos Shaikhmarden and driver Aiyp Tleubergenov were only found in the summer.
In April, a commission consisting of representatives of the Ministry of Emergency Situations, the Akimat of Pavlodar Region, JSC 'Maikainzoloto', LLP 'Republican Central Headquarters of Professional Paramilitary Emergency Rescue Services' and a state labour inspector conducted an investigation into the accident, as a result of which it established 100% employer fault.
On 18 September, it became known that the general director of JSC 'Maikainzoloto', Botin, his deputies Bashirov and Tereshkov, the director of the Maikain underground mine (MUM) Shuvalov, the deputy director of MUM Nazyrov, the chief engineer of MUM Kaiypkanuly, and the chief mine surveyor of MUM Tuleubekov had been detained.
At the same time, it was stated that in March, representatives of JSC 'Maikainzoloto' filed a lawsuit against the Republican State Institution 'Committee of Labour and Social Protection of the Ministry of Labour and Social Protection of the Population' and the State Institution 'Committee for Industrial Safety of the Ministry of Emergency Situations', seeking to have the bus driver found at fault instead of them. However, the company lost the case in court.
Later, it became known that the detained employees of 'Maikainzoloto', who were suspects in the criminal case regarding the death of the mine rescuers, were released under house arrest from the courtroom.
