After 15 September, chairs of the association of property owners (APO) will be elected at meetings for a three-year term and will become members of the house council.
According to the press service of the Akimat of Astana, following amendments to the Law of the Republic of Kazakhstan "On Housing Relations", a candidate for chair and for membership of the council must be the owner of a flat or non-residential premises. Family members of the owner are also eligible for consideration: spouses, children, and parents who permanently reside with the owner.
It was also reported that the chair has the right to represent the interests of the APO in all courts, state bodies, and other organisations without a power of attorney.
In the event of the chair's temporary incapacity for work or another valid reason lasting more than 15 days, the house council may elect an acting chair from among its members. The term of office of such a chair shall not exceed six months.
"The chair is entitled to enter into an employment contract with the manager of the multi-apartment residential building to manage the condominium object. To do this, a meeting resolution or a decision of the house council is required when delegating authority for the manager's appointment," the statement reads.
The manager of a multi-apartment residential building must be a citizen of the Republic of Kazakhstan and possess a document confirming their professional qualifications.
After concluding the employment contract, they are obliged to submit the information to the housing inspectorate to include the details in the register of management entities.
Thus, the chair of the APO retains overall management of the object with the functions of the house council, while the manager operates on the basis of an employment contract.
