Prosecutors in Almaty have uncovered instances of private bailiffs (PBs) failing to take action against more than 1,000 debtors.
According to the press service of the agency, the private bailiffs did not place liens on the bank accounts or property of debtors, did not deduct debts from their wages, and also did not impose restrictions on travel abroad.
“The violations led to debtors persistently evading the enforcement of court decisions and a lack of funds entering the budget, thereby violating the principle of the inevitability of punishment,” the statement said.
As a result of the prosecutor’s order, 50 private bailiffs were brought to disciplinary responsibility, and proceedings were initiated to expel one from the chamber.
As a result of the measures taken, more than 75 million tenge was recovered from the debtors.
Recall that in May, prosecutors in Taraz uncovered the embezzlement of funds by a private bailiff. He transferred 3.1 million tenge, collected from 46 debtors, to his own account.
In November last year, the prosecutor’s office of the Kostanay region established that bailiffs in the region were not closing enforcement proceedings for deceased debtors. This was despite the law requiring the bailiff to suspend proceedings within one working day in the event of the death of the claimant.
