Buying a new smartphone, registering a SIM card, or changing the owner of a device may require mandatory biometric authentication. The Ministry of Artificial Intelligence and Digital Development has proposed new rules for registering and re-registering subscriber devices in Kazakhstan

WHAT RULES IS THE MINISTRY OF DIGITAL DEVELOPMENT PROPOSING

The draft order has been published on the Open NLA portal. Additional guarantees of data accuracy are proposed to be ensured through biometric authentication.

The requirement applies to applicants who apply for registration or re-registration of a smartphone, as well as to primary users of mobile services — citizens for whom a device and mobile number are being registered for the first time.

HOW THE SYSTEM PROPOSES TO CHECK SMARTPHONES

The draft provides for tracking the life cycle of a mobile device — from import or production in the territory of Kazakhstan to repair, resale, cessation of use, or blocking.

Identification codes IMEI are proposed to be automatically verified against the international database of the GSMA association. If the system detects signs of alteration or duplication of codes, or finds the device on an international blacklist, its use on Kazakhstani networks may be restricted.

A separate procedure is also provided for disconnecting communication of devices that are used without authorisation in prisons and pre-trial detention centres.

WHAT STAGE ARE THE NEW RULES AT

The draft order has been developed in pursuance of the instruction of the Prime Minister dated 23 July 2026 and is aimed at implementing amendments to the Law "On Communications", adopted on 19 June 2026.

The document proposes to replace the current rules for registering subscriber devices, approved by Order No. 226 in May 2018. The regulatory legal act is currently at the stage of public consultation.
