In Pavlodar, an entrepreneur was not paid compensation for the loss of bees during the flood.
According to the press service of the Pavlodar courts, at the end of March, meltwater flooded a wintering shed for bees in the village of Rozovka, Pavlodar district. As a result, 80 beehives belonging to a local businessman were submerged.
The entrepreneur applied to the Akimat for assistance in obtaining compensation for property losses, but was refused.
"The district commission decided that the plaintiff's entrepreneurial activity does not comply with the Rules for Compensation of Property Losses Caused to Small and Medium-Sized Business Entities as a Result of the Consequences of the 2024 Floods", the statement says.
The businessman then filed a lawsuit in court, which ordered the defendant to reconsider the entrepreneur's application.
"The commission's decision does not comply with the requirements of the law. The commission's competence includes issuing a conclusion recognising a person as a flood victim, or refusing to do so. The commission did not actually resolve the issue of recognising (or refusing to recognise) the individual entrepreneur as a flood victim. Beekeeping does not require obtaining any permission from a state body. Therefore, the court did not take into account the commission's arguments about the plaintiff's entrepreneurial activity not complying with the Rules", the court ruling stated.
Furthermore, the court identified other shortcomings in the commission's work.
"The decision was not signed by the commission members, there is no information on the results of the vote by the commission members, and a secretary was not appointed when the commission was created. That is, the defendant violated administrative procedures. The court issued a special ruling addressed to the administrative bodies", the court concluded.
