The Chairman of the SRC was fined for using an unregistered order

In Astana, the inter-district court for administrative offences considered a case against the chairman of the State Revenue Committee (SRC) Zhandos Duisembiyev. The reason was an order from the Minister of Finance, on the basis of which tax authorities conducted business inspections.

According to the Telegram channel ‘Kozachkov offside’, the document was marked ‘For official use only’ and contained confidential information, but was not registered with the judicial authorities, rendering it legally invalid. Despite this, the SRC continued to use the order in its work.

The violation was uncovered back in the first half of this year, when several companies appealed against the legality of the inspections. Following court proceedings, the order was revoked, and the Specialised Inter-District Administrative Court of Astana issued two special rulings to the government regarding the elimination of the violations.

Later, the Ministry of Justice drew up an administrative report against Duisembiyev under Article 457 of the Code of Administrative Offences of the Republic of Kazakhstan (‘Violation of legislation on matters of state registration of regulatory legal acts’). The chairman of the SRC himself refused to sign the report, stating that all circumstances should be considered by the court.

The court concluded that Duisembiyev had indeed used the unregistered order. He was found guilty of committing an administrative offence and fined 78,640 tenge. The ruling has not yet entered into legal force.
