Court No.2 in Aktobe has found a district maslikhat deputy guilty of fraud. The case involves two incidents.
As reported by zakon.kz, in 2020 the defendant, while serving as the head of a peasant farm, decided to take out a loan of 780 million tenge. To do this, he provided the Agrarian Credit Corporation with a contract for the purchase of 1,200 head of cattle. However, the former head had no actual means or intention of making the purchase.
"<...> he listed cattle as collateral property that did not exist on the 'K' farm, thereby deliberately misleading [the corporation] about the farm's solvency in terms of available collateral and its overall appearance of prosperity. Having received funds totalling 390 million tenge, the defendant transferred them to the account of his relative's farm 'T'", the court press service reported.
He then transferred 290 million tenge from his relative's farm account to his personal account, and the remaining money to his own farm's account.
In another crime incident, the defendant, from 2021 to 2022, despite not owning any cattle, convinced officials of the regional agriculture department that he did and submitted fraudulent applications for subsidies related to keeping farm animals.
"After which N. cashed out and stole the transferred funds totalling 67 million tenge, spending them on his own needs, thereby causing material damage to the agriculture department", the court reported.
In court, the defendant did not admit his guilt; however, when passing the sentence, the court nonetheless mitigated his criminal liability, taking into account that the man has four young children.
"By the court's verdict, N. was found guilty under paragraph 2, part 4 of Article 190 of the Criminal Code and was sentenced to 6 years' imprisonment, with a 10-year ban on holding positions related to organisational, administrative, and financial responsibility functions in commercial organisations", the court reported.
