The military court of the Aktobe garrison sentenced a sergeant to 1 year of restricted liberty for causing moderate harm to a soldier's health.
According to Press.kz, in August last year, the convicted man, noticing a conscripted soldier using nasvay, forced him to ingest the substance.
The next day, the sergeant made the conscript perform physical exercises, after which he took him to the office, where in the presence of witnesses he struck him in the face with a book and dealt several slaps.
A forensic medical examination found that the victim had damage to the eardrum of the left ear in the form of a rupture, complicated by acute neuritis of the auditory nerve and hearing loss.
“This injury was classified as a moderate bodily injury, as it led to a long-term health impairment (more than 21 days)”, the report states.
The sergeant pleaded guilty. In addition to the penalty of 1 year of restricted liberty, he was ordered to pay the soldier 2 million tenge. Notably, the victim’s side had sought 30 million tenge in compensation.
“The victim’s representative filed an appeal against the sentence and expressed disagreement with the court's decision regarding the civil claim. He stated that due to the lifelong loss of hearing, the victim has lost the opportunity to work in the civil service or law enforcement agencies”, the report states.
The conscript’s lawyer requested the sentence be overturned, the civil claim be granted, and the representative's costs be recovered, but the court upheld the decision unchanged.
Recall that earlier, the military court of the Aktobe garrison had sentenced the platoon commander of the logistics support unit of the medical company of military unit 25744. In March 2024, during the cleaning of the unit's grounds, the sergeant, finding cigarette butts on the floor, forced two conscripted soldiers to eat them, and then beat one of the soldiers.
