Over 50 developers have been penalised for illegally attracting funds from shared-equity investors in Astana.

On the territory of Astana, 37 illegally constructed multi-apartment residential buildings have been identified.

According to the press service of the city prosecutor's office, some construction companies are illegally attracting money from equity holders.

"On these grounds, this year 51 developers have been brought to administrative responsibility under Article 320 of the Administrative Code for 64 construction projects," the statement said.

To date, law enforcement officers are investigating criminal cases against 12 developers.

It is noted that shared participation in housing construction is organised in one of the following ways: 

  • obtaining a guarantee from the Unified Housing Construction Operator (Kazakhstan Housing Company); 
  • participation in a second-tier bank project; 
  • attracting money from equity holders after the construction of the building frame.

"It is prohibited to attract citizens' funds by other means (preliminary reservation agreement, reservation agreements, investment agreements, assignment of claims)," the statement said.

To check the reliability of a developer, the department suggests visiting the website of the Kazakhstan Housing Company, where you can view the register of guarantee agreements for buildings under construction.

Recall that earlier it was reported that in the West Kazakhstan Region, fake developers used fraudulent schemes to obtain money from citizens, without intending to fulfil their obligations. The damage from their actions amounted to 490.8 million tenge.

Shortly before this, in the Kostanay region, due to violations in the field of public procurement, an unscrupulous contractor returned almost 90 million tenge to the state.
