The Court of Cassation has preliminarily examined the petition of Kazakhstani citizen Kairgeldy Smagulov against former President Nazarbayev.
According to the Telegram channel «Nege.Aqsha», Smagulov's lawsuit sought to recover Nazarbayev's assets in favour of the state.
However, the court ruled that there were no grounds for further consideration of his claim.
«Having studied the arguments of the petition, the judge believes there are no grounds for reviewing the judicial acts», the ruling states.
It has become known that this was Smagulov's third attempt to secure the confiscation of the former president's property. Previously, the inter-district civil court of Astana, and then the city court, rejected his demand.
According to Kairgeldy Smagulov, Nazarbayev's actions as president 'threatened the entire human race with destruction'.
For context, earlier, Court No. 2 of Ust-Kamenogorsk considered the petition of the convicted nephew of the former president, Kairat Satybaldy, and commuted his sentence of 6 years' imprisonment to a restriction of liberty for a term of 3 years, 3 months and 7 days.
Meanwhile, the founder of the FBRK, journalist Kirill Pavlov, expressed the opinion that this could be linked to Nazarbayev's health problems.
«Only one factor could have led to such an outcome — the rapid depletion of guarantees. Apart from a shambles [lit: 'shack'], he had and could have had no guarantees or guarantors. Such haste can mean only one thing — the old man has health problems and is on the verge of becoming an ancestor ['aruaq' — spirit of the deceased]. I think the prediction was correct after all, and 2025 will be his last year», the message states.
