A request has been submitted to the Constitutional Court seeking a review of whether certain criminal articles and internal regulations in places of detention comply with the Constitution.
According to the court's press service, these regulations impose a ban on telephone calls for convicts serving their sentences under strict conditions, as well as for those held in disciplinary isolation units.
Currently, convicts placed in disciplinary isolation units and single cells are prohibited from purchasing food and essential items, smoking, and using their beds during the daytime.
According to the applicant, these rules restrict his constitutional right to defence and to receive qualified legal assistance from a lawyer, and also do not comply with UN rules on the treatment of prisoners.
The Constitutional Court has promised to publish its final decision at a later date.
Recall that in July, it was reported that Court No. 2 of Ust-Kamenogorsk passed a sentence on the Deputy Head of the Department of the Penitentiary System Committee for the East Kazakhstan Region, K.A. Ziyanov. He was found guilty of abuse of official power. It is reported that he facilitated the creation of favourable and privileged conditions for serving a sentence for a convict – the former head of ROP Operator LLP, M. Kumargaliyev.
